Teknolojik yenilikler diğer profesyonel meslek alanlarında olduğu gibi avukatlık mesleğinin icrasında da etkisini her geçen gün daha fazla göstermektedir. Özellikle yapay zekâ ile desteklenmiş teknolojik uygulamaların avukatlar tarafından kullanımının artmasıyla mesleğin pratiklerinde de önemli değişimler yaşanabilmektedir. Hukuki işlemlerin farklı süreçlerine uygun çeşitli teknolojik uygulamaların hayata geçirilmesi sayesinde hukuki mekanizmaların işleyişinde kolaylıklar sağlanabilmesinin yanında meslek açısından bazı sorunları da gündeme getirebilmektedir. Bu çalışmanın amacı, avukatların meslek icrasında hukuk teknolojilerinin etkisini yakından incelemektir. Bu kapsamda, nitel araştırma yöntemine uygun şekilde 2021-2022 yılları içerisinde Aksaray Barosu'na bağlı çalışan 18 avukatla derinlemesine görüşmeler gerçekleştirilmiştir. Araştırma bulgularında, gerek kitle iletişim teknolojilerinin ve gerekse yeni hukuk teknolojilerinin avukatlık mesleğinde önemli değişimler yarattığı görülmüştür. Mevcut teknolojilerin (UYAP vb.) mesleğin icrasını kolaylaştırdığını, emekten ve zamandan tasarruf sağladığını belirten katılımcılar yapay zekâ temelli teknolojilerinin karar verme süreçlerine ise daha mesafeli yaklaşmışlardır. Keza teknolojilerin tek başına hüküm vermede kullanılmasının yaratacağı olumsuz sonuçlara dikkat çekerek sınırlı ve sadece yardımcı konumda kullanılması gerektiğini ifade etmişlerdir. Özellikle insan hayatını doğrudan etkileyebilen, vicdani kanaatin önemli olduğu ceza davalarında kullanılması taraftarı değildirler. Kullanılan bazı teknolojik uygulamaların müvekkiller için olumlu işlevler gösterirken kendileri için olumsuz işlevler gösterdiğini de belirtmişlerdir. Avukatların etkileşimde bulunduğu toplumsal ekolojideki düzenlilikler ve ilişkiler de hukuk teknolojilerinin katkısıyla değişmekte, bu durum yeni etkileşim biçimlerini ortaya çıkarabilmektedir. Teknolojinin avukatların müvekkilleriyle iletişimi kolaylaştırdığı; ancak hâkim, savcı ve diğer adliye çalışanları ile iletişimi azalttığı da keşfedilen bulgular arasındadır.

The impact of technological innovations has manifested its strength in every line of business just like the profession of a lawyer. Ever increasing usage of artificial intelligence-based technological applications has particularly created significant changes in the practice of law. The development of technological tools in performing legal transactions has provided convenience in the functioning of legal mechanisms. But it has also created some problems in legal professions. Thus, this study aims to investigate research and analyse the effect of legal technologies (or ‘Legal Tech’) on the daily practices of lawyers. For this purpose, in-depth interviews were conducted with 18 lawyers working in Aksaray city centre in 2021-2022. The participants of the research have taken advantage of such technologies (just like UYAP) and they stated that these technologies have saved time and labour. However, they also asserted that artificial intelligence-based technologies have created problems in decision-making processes. Furthermore, the participants have drawn attention to the possible negative consequences of these technologies in the sentencing stage. They stated that these technologies should be used only in a limited and auxiliary position in this regard. They are not in favour of using them, especially in criminal cases that can directly affect human life and where conscientious conviction is crucial. They also stated that some of the technological applications have positive functions for the clients while they have negative functions for themselves. Regularities and relationships in the social ecology in which lawyers interact are also changing with the contribution of legal technologies. Therefore, new forms of interaction are being formed. It is also among the findings discovered that technology facilitates the communication of lawyers with their clients while reducing their communication with judges and prosecutors and other courthouse employees.
